The ITC determines whether increased imports are a substantial cause of serious injury or threat of serious injury to a U.S. industry producing like or directly competitive products. If the ITC finds injury or threat, it makes remedy recommendations to the President. The President makes the final decision whether to provide relief to the U.S. industry and the type, amount, and duration of the relief.

미국의 산업피해 구제법
특정물품의 수입이 급증하여 수입국의 국내산업이 입는 피해나 피해의 위협으로부터 일시적으로 구제하는것을 목적으로 하고 있으며, 이러한 목적을 갖기 때문에 GATT(1994)제19조에서 ‘특정상품의 수입에 대한 긴급조치’로 규정되어 있으며 GATT협정이 의무로부터 ‘면책조항’, ‘SAFEGUARDS’라고 불리기도 한다. 대통령은 미국산업을위한 시정조치를 규정하고 시정조치의 지속기간, 양, 유형의 최종결정을 한다.
